High Court Cancelled Modi Ji’s Seat in Election:

The high court of Allahabad on Wednesday cancelled the petition filed by prime minister Mr. Narendra modi for the election of the prime minister from Varanasi. The court showed very less interest in the petition. The petition was half hearted and termed as “useless” as per the media reported. Ajay Rai, the petitioner from Uttar Pradesh was the congress party’s candidate from Varanasi during elections held there in 2014 has challenged Mr. Modi’s election on a number of grounds like expenditures on the election campaign trail, use of religious sentiments to garner votes and much more.

Though Mr. Modi’s councils had strongly opposed the contentions that were raised by Rai. Judge stated, No material has been placed on record to make the petition ethnic. Rai, forfeited his petition one sided that more than 50 crores rupees has already been spent on Modi’s election campaign. He has also claimed that a number of hotels were even earmarked for the purpose. Along with this he has stated, more than 400 vans had been plied for the popularizing the slogans.

The court has concurred with the submission of additional solicitor general of India, Satyapal Jain, that, the petitioner has failed to produce any material on record to show the expenses that were made directly by the candidate or his supporters upon his directions. Again, while putting the allegation that more than 50 crores of rupees  has been spent, the petitioner has failed to show any solid evidence as to the payments were done by whom and what was the mode of payment.

There is a lack of specific pleadings and the allegations that were made. The court has remarked the vague and bold statements given by Mr. Rai that were purely based on the media. The proceedings of the order by the judge that began on Monday ended on Wednesday. Earlier Court had turned down the petitioner’s other contention that by writing not known in columns meant for assets as well as liabilities of his wife, Jashodaben, Modi had failed to provide details in his nomination papers as required under law.

Aiming out that laws relating to elections were highly technical the court said “it was mandatory on the part of the petitioner to establish that Mr. Modi was in full knowledge of the assets and responsibilities of Jashodaben and yet he did not disclose the same in his papers.”

However, no such thing was stated by the petitioner. This does not make the petition fit for intervention, the court added. He was fielded from Varanasi in 2014 general elections, however Rai, finished a distant third. He lost very nearly. He started from BJP MLA in 1990s. He parted ways with the party during 2009 Lok Sabha polls where he contested unsuccessfully as a Samajwaadi party candidate from Varanasi. This seat was bagged by Murli Manohar Joshi. Then he joined congress ahead of 2012 the assembly polls and impressed the party as he won this election and carved out a seat.
