The government of Uttar Pradesh has decided to take the views of Muslim women in the matter of triple talaq based on which, the Yogi government will present their side in the Supreme Court hearing the issue. Yesterday, the Chief Minister of Uttar Pradesh Yogi Adityanath said that his government will put its side to the Supreme Court after taking the views of Muslim women. “The state government will put its side in the SC on triple talaq after taking the views of Muslim women,” said Chief Minister Yogi Adityanath while addressing a meeting with the Women and Child Development Department.
The Chief Minister Yogi Adityanath directed officials to make a plan for taking the views of Muslim women and said to the minister of the department and all women ministers in his department “to talk to women organizations”. This issue of triple talaq will be discussed in a two-day meeting of the All Indian Muslim Personal Law Board (AIMPLE), which is scheduled for April 15. Many of the Muslim women have filed PILs in the Supreme Court challenging the terms of triple talaq and ‘Nikah halala’, calling them regressive.
However, the board has opposed the PILs and filed the contradict affidavit in the apex court defending the Muslim Personal Laws and triple talaq. On October 7 last year, the centre had opposed the practice of triple talaq, ‘nikal halala’ and polygamy in the Supreme Court among Muslims and recommended a relook on grounds like gender equality and secularism.
The Law and Justice Ministry had referred to constitutional principles like gender equality, international covenants, religious practices, secularism and marital law prevalent in various Islamic countries to make the point that the practice of triple talaq and polygamy needed to be pass judgment upon once again by the apex court said in its affidavit. The apex court had taken Suo Motu knowledge of the issue whether Muslim women faced gender discrimination in the norms of divorce or due to other marriages of their husband.
The Uttar Pradesh Chief Minister Yogi also directed the officials to prepare compulsory rules regarding marriage registration in the state. At the time of presentation of Minority department, the Chief Minister Yogi Adityanath asked the officials to update madrasa education and include English, professional and skill development courses as well. The CM also directed the land be identified in every district for the construction of community centers for minorities and all the arrangements made for Haj pilgrims.
During the late night meeting with top ministers and officials of various departments on Tuesday, it was decided that a special task force will be formed that will meet Muslim women across the state to know their point of view on controversial issues like triple talaq. This task force will include the minister of the concerned department and all the women ministers from the cabinet as well. They will talk with various women’s organizations to know the opinion of Muslim women on this matter.
The Women and Child Welfare Minister Rita Bahugana Joshi said that they will take the opinion from the Muslim women on the issue. “My department is working on a proposal on how to approach Muslim women to seek their opinion,” said the Minister. The saffron party has been against triple talaq from a quite long time. The Yogi government is going to share the difficulties of the Muslim women in the Supreme Court by taking their stand and opinions on it.
