Jetmalani Withdraws his Name as a Lawyer in Defamation Case Against Kejriwal

In the case of defamation by Union Minister Arun Jaitley against Delhi’s CM Arvind Kejriwal, the famous lawyer Ram Jethmalani, who is present on behalf of Kejriwal, has now left Kejriwal and has demanded the payment of fees.

Ram Jethmalani, senior adviser to CM Kejriwal, has written a letter to Kejriwal asking him to and pays his legal fees and told him that he is withdrawing himself from the defamation case. Ram Jethmalani has taken this step after refusing to use abusive language against Arun Jaitley on the directive of Kejriwal. Senior lawyer Jethmalani wrote a letter to CM Kejriwal alleging that he used more objectionable and hate speech Arun Jaitley.Jethmalani has also asked Kejriwal to pay legal fees of more than Rs 2 crore in the defamation case against Kejriwal and 5 other AAP leaders. During the hearing of 10 crore defamation case against the leaders, Jethmalani had made an indecent remark against Jaitley.

Jaitley had then sought an explanation from Jethmalani whether he used the language of the hate speech on his client Kejriwal’s instructions. Kejriwal’s party Jethmalani responded in yes and after this Jaitley sued Kejriwal with another defamation case. After being caught in another defamation case, Kejriwal filed an affidavit in the Delhi High Court and wrote a letter to Jethmalani that he did not give any direction to use  the derogatory word against Jaitley. In his affidavit, Kejriwal said, “It is beyond comprehension that I will ask senior adviser Jethmalani to use such objectionable words. Neither I nor my counselor Anupam Srivastava had instructed Jethmalani to use such objectionable words on 17th May.

In response, Jethmalani has also decided to withdraw from this defamation case and asked Kejriwal to pay his legal fees This fee is more than 2 crore rupees. The Delhi government had earlier paid Jethmalani’s Rs 3.5 crore fees in February. Ram Jethmalani has appeared in the courts 11 times on behalf of Kejriwal. Jethmalani received Rs 1 crore retainer and a fee of Rs 22 lakh per hearing. However, the CM’s office has refused to comment on the matter. The CM office said that till now, he has not received any information regarding the withdrawal of Jethmalani’s case. Jethmalani told us in the conversation, Kejriwal had written a letter to me, I sent a reply to him. I will not disclose the conversation I have made in this letter. You can ask Kejriwal to make both papers public because I have promised him that I will not make anything public.

CM Yogi Launches UP-RERA Site, Builder Can be Back in Business Again

The Chief Minister of Uttar Pradesh, Yogi Adityanath, launched the online Real Estate Regulatory Authority (RERA) registration platform today in Lucknow. On the other hand, the Confederation of Real Estate Developers Association (Credai) expressed pain relief with the launch of the online RERA registration site. This heralds heading back to business as they might now have the ability to endorse their future projects officially for the builders following the RERA registration.

In Uttar Pradesh, not like many states, the builders can enroll their projects on the website and immediately will receive a RERA registration number. This bodes well for all the builders who were not getting the chance to advertise their forthcoming projects in the media as the Act averted any non-RERA project to be bought from in the state. The builders will have now four days (until 31st July) to join in their ongoing projects. An advantage of a few days has been expected for everyone to seriously come to the table with the Uttar Pradesh Real Estate Regulatory Act (UP-RERA).

The president of Credai-NCR, Manoj Gaur, said to the Times of India (TOI) over a call from Lucknow that “This comes as a huge relief and the instant registration number is a great feature. So builders can today itself register their project and then advertise their upcoming projects. Business should get moving now. While July 31 is the last official date for existing projects, we hope the builders would get a few days grace to comply. Over all, it is good news for all stakeholders”. While commenting on the launch, the Supertech chairman RK Arora said, “We were already prepared with our paperwork for this. So we will register all our projects today.”

On the other hand, the buyers’ quarters looked like a displeased because the UP-RERA enrollment is likely to be carried out in the set-up as executed by the ex-state government in October 2016. The buyers today intimidated to challenge the UP-RERA in court as a number of clauses regarding action against contractors for noncompliance being diluted in this format. The president of Noida Extension Flat Owners Welfare Association, Abhishek Kumar, said that “It has been our singular demand to implement RERA in UP in its pure form as introduced by the Union government. The UP version of RERA is soft on builders and we will challenge this in court”. Nefowa is a prominent runner in the countrywide ‘Fight for RERA’ campaign for last some years before the RERA bill was cleared and the Act formulated.

Explosive Discovered in the UP Assembly, CM Called a High-Level Meeting

The white powder found in the UP assembly on July 12 was explosive. When the team of anti-mining and dog squads were checking inside the assembly, during that time they got white powder. This powder was sent for forensic examination. It is found in the investigation that this powder is plastic explosive PTEN, but it works only with detonators, does not explode separately. The explosive was placed at the place where leaders of all parties sit. Weighing around 60 gm, the packet was reportedly found under the seat of Samajwadi Party MLA Manoj Pandey. After this CM Yogi Adityanath had convened a high-level meeting.

Discovering explosive inside ongoing session in assembly is quite worrisome and it is a part of dangerous conspiracy. The question that remains unanswered is that how is it possible for someone to plant an explosive inside the assembly, because entries in the UP Assembly have to go through multi-level security cycles. Not only that, only the legislators, ministers and cleaning workers are allowed to go to the assembly. Congress leader Akhilesh Pratap Singh said that, it reflects the true condition of security in the state, when these people can’t secure the assembly, how will they protect the public?
UP government Minister, Siddharthnath Singh said that, “the security personnel are doing their job, nobody has to worry about it. Terrorists are busy spreading their arms all over the India, but there will be no place in UP.” Samajwadi Party leader, Rajendra Chaudhary said that, “this is a very dangerous situation; there is a need for intensive investigation.” He also raised the question on the security of the state and that, “if this is the situation in the assembly, then you can guess the security of the rest of the UP.”

As soon as CM Yogi Adityanath came to power, he assured the public that he would correct the security arrangements of the UP, but now the meeting of the explosive in the Assembly itself raises many questions on the promises made by him. When the assembly of the UP is not safe, then what will happen to the state?

Soon after, the defamation complaint by Amit Sibal, in July 2013,  the Patiala House court issued summons to Kejriwal. Kejriwal sought a permanent exemption from appearance in the case, in December last year.

In 2013, lawyer Surender Kumar Sharma filled  third defamation case against accused Arvind Kejriwal and his deputy Manish Sisodia of defaming him by denying AAP ticket for Delhi Assembly election after announcing him as party candidate. Kapil Mishra Submit Proof Against Kejriwal, Water Tanker Scam, CBI To Probe

From internal party fights to losing the elections of Punjab assembly and Delhi MCD elections and now, the allegations by a sacked minister of taking the cash of 2 crore cash, time is definitely not going well for the Delhi Chief Minister Arvind Kejriwal and his Aam Aadmi Party (AAP). Today, the sacked water resources minister Kapil Mishra submitted the proofs to the Delhi Anti-corruption Branch (ACB) and detailed evidence on the 400-crore water scam as well. He also said that he will approach CBI.

The sacked Aam Aadmi Party minister Mishra previously alleged that he witnessed the health and PWD minister Satyendra Jain passing on Rs 2 crore to Delhi Chief Minister Arvind Kejriwal. As per the Kapil Mishra, Satyendra Jain told him in a private conversation that he had fixed a Rs 50 crore land deal encouraging of a relative of the Delhi Chief Minister. While talking to the reporters outside the Anti-corruption Branch, Mishra said, “Whatever evidence I have, I gave it to the ACB, will be summoned again to assist in the probe.” Mishra also said that he had requested for an appointment with the Central Intelligence Bureau (CBI) to reveal them about his claim of Health Minister Satyendra Jain giving unaccounted Rs 2 Crore to Arvind Kejriwal. Previously, the Delhi Lieutenant Governor of Delhi Anil Baijpal already forwarded Mishra’s complaint to the Anti-corruption Bureau of Delhi.

On Sunday, Mishra claimed that he was shocked when he saw Jain giving Rs 2 crore to Kejriwal. “I saw Kejriwal take Rs 2 crore from (Health and Transport Minister) Satyender Jain. Jain told me he had struck a deal of Rs 50 crore for one of Kejriwal’s relatives. When I told Kejriwal about this he said, ‘This is false and you should have faith in me’. I told him I trust him but having seen the cash with my own eyes, it was not possible for me to keep quiet,” Mishra said while addressing the media at Raj Ghat.

The leaders of the AAP are supporting firmly the chief minister of Delhi and saying that “even his (Kejriwal’s) enemies will not believe it”. Ex-minister Kapil Mishra was sacked on Saturday night by saying that there was some “mismanagement in the water supply” whereas Mishra claimed that it was a conspiracy originated against him as he alleged the Rs 400 crore water tank scam in the government. The opposition parties got a reason to rejoice again and to criticize the AAP leader Arvind Kejriwal again. They are leaving no stone in making the issue bigger and have also asked for the resignation of the Delhi’s CM Arvind Kejriwal.

Delhi chief of BJP Manoj Tiwari was quick to respond to this controversy and said that the Lieutenant Governor should “examine the possibility of recommending the dismissal of the AAP government to the President”. On the other hand, the congress leader Ajay Maken said that the allegations are very serious and Kejriwal’s party had lost its agenda to fight against corruption. Ajay Maken said “This is not a single allegation that has been made. Out of a total of seven, who had taken an oath to fight against corruption, six have been removed so far. It explains that the party has lost its basic premise of being against corruption”.  Talking outside the ACB office, Mishra said “lie detector test should be conducted on Arvind Kejriwal, Satyendra Jain and me. I am ready to undergo the test”.

There is no doubt in that it is going to be a huge task for the AAP supremo Arvind Kejriwal and his party to survive from this weathering storm that party has been going from the last some months. After appearing out of Delhi Anti-corruption branch, Kapil Mishra says that “have submitted information on water tanker scam. Have submitted info as a witness and complainant. Have given info how the investigation into tanker scam was repeatedly delayed, how some officials tried to cover up and how even taking the case against Sheila Dikshit was suppressed.

I have given the names of Ashish Talwar and Vibhav Kumar”. The BJP spokesperson Rajiv Babbar said that the Delhi BJP has filed a complaint against Arvind Kejriwal to the Delhi Lokayukta. Mishra tweeted today that “Anyone who dares to speak up should not be called an agent of BJP or Modi… Old tricks won’t work this time”. It looks like that the coming days are very crucial for the Delhi CM Arvind Kejriwal and his party. We think it is the high time that Kejriwal should come up front and speak his side on this controversy.

How To Be A Good MLA?, CM Yogi Master Class For First Timers

The Chief Minister of Uttar Pradesh Yogi Adityanath has been in the news from the time he had been elected as the CM of the state. Now, the cm Yogi has decided to start a crash course for the state’s 403 legislators to deport themselves in the House. The focus of the Yogi is to inform the basic lessons of the first-time elected MLAs. This two-day “enlightenment course” started with the speech of the CM of state Yogi Adityanath, who is also a first-timer in the UP assembly, although Yogi has been elected as the Member of Parliament for the five times. It will be addressed on Thursday by the speaker of Lok Sabha Sumitra Mahajan.

Senior Union Ministers like Prakash Javedkar and UP governor Ram Naik has been roped by the CM Yogi to speak to the MLAs. The former legislators will guide through their sessions that how to raise questions in the assembly and how to sustain the decorum of the legislative assembly. From May 15, the Uttar Pradesh assembly’s session will begin and it will be held in Lucknow at the UP Vidhan Sabha premises. The Bharatiya Janata Party shocked everyone with its extraordinary performance in the state.

In their landslide victory in the UP, the BJP itself won 312 seats; with allies, they touched the number of 325 seats. There are more than 200 legislators who have been elected for the first time in the assembly. Akhilesh Yadav’s Samajwadi Party performed poorly in the elections and won barely 47 seats, where we saw that the Mayawati’s BSP weakened to just 19 seats. The good thing is that the legislators from these parties as well are going to attend the two-day course.

The CM Yogi has notched up several firsts since he became the Chief Minister of the state, however, the two-day workshop for MLAs would not be counted among them. The former CM of Uttar Pradesh Akhilesh Yadav also had organized the workshop after he took oath as the CM of the state in 2012. Since the time Yogi has taken charge as the CM of the state, he had ordered many of the changes and new policies for the officials and ministers in the government. Yogi also cleared that he expects 18 hours to work in a day.

In a recent meeting with the workers of the party and the leaders to address the recent incidents of high-handedness by BJP lawmakers and the ministers in the state, the CM said that don’t take the law in your hands. “Don’t take the law in your hands. Tell the government where the shortcoming is. The government will act,” Yogi said. He also added that when ministers tour districts, then they “should not be welcomed with garlands and bouquets.”
